Terms/Warranties
The following Terms and Warranties apply when you order from Monster Ford Performance Products, LLC, whether your order is placed On-Line, by telephone, or by FAX:
PAYMENT OPTIONS:
We accept Visa, MasterCard, American Express and Discover credit cards on most orders placed On-Line, by telephone, or by FAX. For your protection, we require your complete name as shown on your credit card, the complete account number and the 3-digit security code or CCV (Credit Card Verification Code) found on the back of your card. In addition, your mailing address must match the mailing address EXACTLY as shown on your credit card statement. We will ask you to provide other information to verify your identity. All orders will be shipped after your credit card transaction has been properly authorized by the credit card issuer. You agree not to charge back a transaction made with us on your credit card. If you have a problem with an order or you have not received it, you agree to contact us to resolve the problem. Customer satisfaction is a high priority for us because if you are satisfied with your purchase experience with us, we believe that you will continue to purchase more products from us…your satisfaction is just plain good business!
You may also pay for your order by Bank Cashiers Check, Western Union Wire Transfer or Money Order. Your shipment will be held until all funds have cleared our account.
Please do not send us CASH in payment of an order! We do not recognize, and we will not be held responsible for loss or theft of a CASH payment. We Do NOT Ship COD Orders.
SHIPPING AND HANDLING POLICIES:
Orders over $150.00 placed with us for delivery within the continental United States are Shipped Free of Charge. For some products, we ship via United States Postal Service Priority Mail. For these shipments, we will receive an electronic confirmation that your product has been delivered. For most orders, we will ship via FedEx Ground. All such shipments are insured for the full value of their contents, and an adult must be available to sign for the shipment. It is the Customer’s responsibility to inspect each product shipment if it appears that a shipping carton or product has been damaged during shipping, and to make the proper claim for damage with the carrier. Please contact us so that we may help facilitate the claims process with the carrier. FedEx Ground delivers on Tuesdays through Saturdays from 10:00 am to 8:00 pm. Some items are shipped to you directly from a factory when we are out-of-stock. Larger items may be delivered to you by a common carrier such as a trucking company. We do not charge any handling or other hidden charges!
We can accommodate you when you need an order right away. FedEx Ground usually takes between 2 to 5 days depending upon where you live. USPS Priority Mail has guaranteed delivery within 2 to 3 days. Please call or e-mail us if you need an order more quickly, and we can quote you an additional shipping charge for Express Shipping Services.
INTERNATIONAL SHIPMENTS AND SHIPMENTS TO ALASKA OR HAWAII:
Shipments to Alaska, Hawaii and certain zip code areas designated as “Rural” may be subject to additional shipping charges. Please call or FAX us for a shipping charges quote when placing your order.
International Orders are NOT shipped FREE! All such orders are subject to shipping, brokerage, insurance, customs duties and other related fees and charges. We will respond to an International Order placed On-Line by e-mailing or FAXING the Customer. Shipping charges on orders to Alaska, Hawaii, other United States terratories and Other Countries are entered into our credit card system as a separate charge, and your credit card statement will reflect 2 charges, one for the amount of the merchandise ordered and one for the shipping charges.
RETURNS AND EXCHANGE POLICIES:
You must contact us by e-mail or FAX before you make any attempt to return a product to us. We will not accept any shipments from customers who have not contacted us for an approval, in which case we will issue you a Return Authorization Number. All returns that we approve must be shipped to us pre-paid and must have printed on the shipping carton the Return Authorization Number. Returns which do not conform to our policy will be refused. If we ship you the wrong item, you will be given a credit for your purchase price, or you may request that we exchange the item for a different one (you will be responsible for paying us the difference in purchase price for the new item). All other returns which we approve will be subject to a return handling fee equal to 20% of the purchase price of the product which we allow you to return plus the shipping charges which we paid when you ordered the item. If you originally paid by a credit card, we will only issue a credit against that particular credit card.
BACKORDER POLICY:
Occasionally, backorders can occur even though we carry a substantial inventory of product. If we are temporarily out of a particular product, we will make every effort to get it shipped to you as quickly as possible. To facilitate this process, we may sometimes have the product shipped directly to you from the manufacturer. If a product has been discontinued by a manufacturer, we will refund your purchase price. Please contact Customer Service with any questions about any backorders.
WARRANTIES:
All product warranties are expressly limited to those warranties which are offered by the manufacturer of any product ordered through Monster Ford Performance Products, LLC. Please check the terms and conditions of each product warranty. All sales of products are made by Monster Ford Performance Products, LLC, and accepted by Customer without any other warranties, expressed or implied, including, but not limited to, any warranties of Merchantability or Fitness for a Particular Purpose, and Monster Ford Performance Products, LLC, shall not be liable to Customer or any other party for damages or injuries, of any nature whatsoever, which may be sustained as a result of improper installation, misuse of a product, product design, product defect, or product failure.
FRAUDULENT CHARGE BACKS:
Unfortunately, there are a small number of people who will charge a product on their credit card, actually receive the merchandise, and then attempt to charge back their credit card purchase under the pretense that the Customer never received what was ordered. We take this fraudulent conduct very seriously! Our policy is to dispute every charge back after our investigation concludes that the Customer received the shipment. By placing an order with us, the Customer expressly agrees: to submit to the personal jurisdiction of the Superior Court in Hillsborough County, New Hampshire, and that it shall be the only venue for any action brought by us or by the Customer for a disputed shipment of product ordered through us, or for any charge backs by the Customer to the credit card used for any purchase from us; to waive any and all rights to a trial by jury; to pay all monetary damages incurred by us if a judgment is awarded to us against the Customer by the Superior Court; and to pay all costs and attorney’s fees incurred by us, including those costs and attorney’s fees incurred by us in connection with enforcing and collecting, in any state, any judgment awarded to us, together with interest on any such judgment, attorney’s fees and costs awarded to us at the rate of 2% per month until the entire amounts have been paid in full.
PERSONAL AND FINANCIAL INFORMATION/PRIVACY:
Notice To Customers:
We will comply with all applicable laws and regulations governing the security, collection, retention and use by us of all of your financial information, including credit cards, and all other personally identifiable Customer information. We will not sell to any third party any of the above information. We may use such information in the resolution of disputes. We are keenly aware of credit card fraud, including fraudulent charge backs and identity theft! Therefore, we take certain measures to verify the validity of all credit card transactions. We will ask you to provide us with your 3-digit CCV or Credit Card Verification Code on every credit card transaction. We may ask you to provide certain personal identifying information such as your driver’s license number, expiration date, and the state in which it is issued. We will maintain controls to ensure that your personal information is kept private and will be used only by us in connection with a sales transaction with us. Your personal information will not be disclosed to anyone, except to process credit card transactions, including those we must process on-line through a virtual gateway service, in cases where it becomes necessary to prevent credit card fraud, fraudulent charge backs, identity theft, and in cases where we are obligated by law or a lawful court order to disclose this information. Court judgments awarded to us against the Customer may be reported by us to a Credit Reporting Agency.
TYPOGRAPHICAL AND OTHER WEBSITE ERRORS:
All efforts are taken to ensure the accuracy of all pricing and other information contained on our website. However…to err is human! Errors is typographical content, pricing and photography are promptly corrected when discovered. Content, pricing and depictions of products are subject to change without notice.
YOUR AGREEMENT WITH OUR TERMS AND WARRANTIES:
When you press the “Submit Order” Button after placing your order on our website, you are expressly agreeing to all of the Terms and Warranties outlined above. You also expressly agree with our Terms and Warranties when placing an order with us over the telephone, by FAX, or by any other method.
